GDPR information clause

  1. The administrator of the personal data is Kancelaria Radcy Prawnego Dr. hab. Iwony Gębusi (the Law Firm”) with its registered office in Warsaw at ul. Sienna 41 m. 13, 00-121 Warsaw. The personal data collected by the Law Firm shall be processed in accordance with the principles set out in particular in the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation) (the GDPR”) and the Act of 10 May 2018 on the protection of personal data. The Law Firm shall keep personal data confidential and protect them from unauthorised access by third parties.

  2. The Law Firm processes personal data:

    1. for the purposes arising from the legitimate interests pursued by the Law Firm as data administrator: for the provision of services to clients, marketing of services, as well as for analytical and statistical purposes and for the purpose of ensuring ICT security related to the website: www.legalinsight.pl (Article 6(1)(f) GDPR);

    2. for the purpose of performing contracts concluded by the Law Firm with its clients, including the organisation of training courses, for the purpose of cooperating with suppliers and other entities cooperating with the Law Firm (Article 6(1)(b) GDPR);

    3. in order to recruit individuals interested in working or cooperating with the Law Firm (Article 6(1)(c) and Article 6(1)(a) of the GDPR, respectively);

    4. in order to fulfil legal obligations incumbent on the Law Firm (Article 6(1)(c) GDPR).

  3. The processing of personal data is carried out on a voluntary basis, however (depending on the circumstances) a refusal to provide data or a request for deletion of data may make it impossible, for example, to contact you, to provide you with information about the Law Firm’s events and activities or to perform a service. Sending commercial information electronically, e.g. by e-mail, is subject to prior consent, including by submitting an instruction to receive specific information.

  4. In accordance with the principles set out in the legal provisions on the protection of personal data and to the extent provided therein, you have the right to access yourpersonal data, the right to rectification, deletion or restriction of processing and the right to data portability. If you do not want the Law Firm to process your personal data for marketing purposes, you may object to the processing of your personal data for this purpose at any time. If you have given your consent to the processing of your personal data, you may withdraw it at any time; however, the withdrawal of consent will not affect the processing that took place before the cancellation of consent

  5. You have the right to lodge a complaint relating to the processing of your personal data by the Firm to the President of the Office for Personal Data Protection.

  6. Personal data will be processed respectively:

    1. until the legitimate interests pursued by the Law Firm as data administrator related to the processing of specific data are realised;

    2. until the expiry of the statute of limitations related to the contract to which the processing of personal data is connected, or related to the statute of limitations of obligations arising from the law;

    3. until an objection is raised with regard to the processing of data for marketing purposes.

  7. Recipients of personal data may be, in particular, external service providers (e.g. IT service providers, including cloud computing services, service providers of marketing and promotional activities, other entities processing data on the basis of a contract of entrustment of personal data processing), accountants, public administration bodies and courts.

  8. Personal data shall not be transferred to countries outside the European Union. In the event that personal data is transferred to third countries outside the EU, the Law Firm will use appropriate instruments to ensure the security of personal data.

  9. The Law Firm, in connection with its cooperation with its suppliers and other law firms, may entrust the processing of personal data to the above-mentioned entities. In each case, these entities will be obliged to maintain the confidentiality of the personal data and to process them in accordance with data protection legislation and the relevant instructions of the Law Firm.

  10. Personal data shall not be subject to profiling as one of the forms of automated processing of personal data.
